Government Putting Small Business, Consignment Shops At Risk

In quite possibly the most over the top knee jerk reaction ever, the government may be outlawing your child’s favorite books, clothing, and more.
The Consumer Product Safety Improvement Act (CPSIA) that’s set to reduce lead content in an assortment of children’s items by Feb. 10 may inadvertently put countless small businesses across the United States out of business.
The act, signed into law by President George Bush on Aug. 14, 2008, imposes new lead and phthalates testing and sets new acceptable levels for several other substances.
A wide variety of children’s products will fall under the CPSIA umbrella, including toys, apparel, electronics, books, school supplies and video games. Essentially, anything used by children 12 years of younger could fall under that blanket. The burden will be on retail stores to make sure the items they sell fall under legal levels. That will be expensive, if not impossible, for many consignment shops.
“Without any changes or amendments, we will likely have no choice but to close,” said Kasey Brown, who owns Hey Baby Boutique in Ionia. “I do not think this was a very well thought out law.”
The testing for lead content falls far, far out of range of most of the small business. The simply cannot afford to test everything. Anything not tested will automatically be considered toxic and will have to be destroyed.
Countless books, clothing, and much more regardless of any actual risk posed will be destroyed after the assigned date.
